Aspects from the law of Allah (God) in
Jurisprudence |
Pondering upon these
aspects |
That Allah (God)
may requite each person according to what he has earned. Truly,
Allah (God) is Swift at reckoning.
The Noble Qur’an (14: 51) |
A person
notices upon reflecting upon the verses of The Noble Qur'an that
Allah (God) Almighty emphasizes that He is swift in Judgment in
most places where Judgment is mentioned. This shows a side of
the mercy of the creator in the laws of Islamic Jurisprudence,
which is that swiftness in judgment is a mercy towards the
person who did a bad deed such that the punishment is over very
quickly and the person does not go into a cycle of slow
punishment.
We notice
that there is no prison in Islamic Jurisprudence because
punishment is done swiftly. This contains so much mercy towards
people because imprisonment causes so many psychological
problems to the captive, such that hate, anger, disgust, and
other symptoms develop within the captive. Also prisons take so
much financial resources and time from those guarding the
prison.
From this
it can be concluded that there is so much mercy in the swiftness
of carrying out punishment, which testifies to the truthfulness
of the words (Truly, Allah (God) is Swift at reckoning.) |

Cut
off (from the wrist joint) the (right) hand of the thief, male
or female, as a recompense for that which they committed, a
punishment by way of example from Allah (God). And Allah (God)
is AllPowerful, AllWise.
The
Noble Qur'an (5: 38) |
If we
reflect upon the wisdom of Allah (God) Almighty and His mercy in
the punishment for who steals (which is for his hand to be
cutoff). The wisdom in that is that Allah (God) wants for people
success in the hereafter by going into Paradise, such that the
hand that a person uses to steal with would cause him to go into
Hell, so it is better for a person who steals to live in this
short life without it rather than going into Hell because of it.
This testifies to the truthfulness of the following words of the
Almighty in the Noble Qur'an (Allah (God) knows and you know
not).
Also when
a person knows that the punishment for stealing is the hand
being cut, then a person who is thinking of stealing would think
so much before carrying out what he wants. This would result in
the abolishment of the crime of theft in socities.
From
another aspect, a person who steals once is more likely to steal
again, such that when this person thinks of stealing again and
sees the site of the cut in his forearm then this would refrain
him from stealing again.

The
woman and the man guilty of illegal sexual intercourse, flog
each of them with a hundred stripes. Let not pity withhold you
in their case, in a punishment prescribed by Allah (God), if you
believe in Allah (God) and the Last Day. And let a party of the
believers witness their punishment. (This punishment is for
unmarried persons guilty of the above crime but if married
persons commit it, the punishment is to stone them to death,
according to Allah's (God) Law).

Another
side in Islamic Jurisprudence is that the adulterer and
adulteress should be lashed 100 times. Thus the mercy of Allah
(God) Almighty in this is that the skin who the Almighty created
from humans if used in the deeds that are pleasing to Allah
(God) then the person would be rewarded, while if a person uses
his skin in deeds displeasing to the Almighty then the
punishment is sever.
Also Allah
(God) Almighty wants for people to go into paradise and if
adultery would cause a person to go into Hell then it is better
for a person to feel some pain in this short life which would
refrain him from going into Hell rather than going into eternal
punishment. This testifies to the truthfulness of the following
words of the Almighty in The Noble Qur'an (And verily, Allah
(God) will make them taste of the near torment (i.e. the torment
in the life of this world) prior to the supreme torment (in the
Hereafter), in order that they may (repent and) return.

O you
who believe! Al-Qisâs (Islamic Laws of Jurisprudence) is
prescribed for you in case of murder: the free for the free, the
slave for the slave, and the female for the female. But if the
killer is forgiven by the brother of the killed against blood
money, then adhering to it with fairness and payment of the
blood money, to the heir should be made in fairness. This is an
alleviation and a mercy from your Lord. So after this whoever
transgresses the limits (i.e. kills the killer after taking the
blood money), he shall have a painful torment.
The
Noble Qur'an (2: 178) |
Allah
(God) Almighty states that the punishment for a person who kills
another deliberately is for him or her to be killed. The mercy
of Allah (God) in this is that it is easier for a person who
kills once to kill again, thus by killing this person then
killing in societies would decrease and peace would prevail.
Also the Almighty states that if the relatives of the deceased
forgive the killer, then the killer should do right to the
relatives of the deceased to soften what has befallen upon them. |
